1. Scope and Key Definitions

  • “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked (directly or indirectly) with you or your device.
  • “Customer” means an organization that holds an account on the Service, and “Customer Data” means the forms, templates, branding, and settings a Customer builds in the Service and the submissions, files, and other information Respondents (people who fill out a Customer’s forms) provide through them.
  • “PHI” means protected health information as the Health Insurance Portability and Accountability Act (“HIPAA”) defines it.
  • “User Content” means content you provide to us outside of Customer Data (for example: questions, messages, feedback, testimonials, and, for staff accounts, pages and other content for the Site).
  • “AI Output” means content generated by artificial intelligence tools, whether tools we use to operate the Site and our business or third-party AI systems that read the Site (which may be inaccurate or incomplete).

1.1 Customer Data Is Processed for Our Customers

When a Respondent fills out a Customer’s form, the Customer decides what to collect and why, and we process the Customer Data on the Customer’s behalf, under our Terms of Service and, where the Customer Data includes PHI, under a Business Associate Agreement (“BAA”) with that Customer. The Customer’s own privacy notice, not this Privacy Policy, governs that information. If you are a Respondent and have questions about a form you filled out, or want to access, correct, or delete your submission, contact the organization whose form it was. We will refer requests we receive to the Customer and assist it as our agreements and the law require. We do not use Customer Data for our own marketing, and we do not sell it.

This Privacy Policy applies to information we collect for our own purposes: from visitors to the Site, from the people who hold accounts on the Service, and through our marketing.

2. Eligibility and Children’s Privacy (18+)

The Site and account holding on the Service are intended for individuals 18 years of age or older. We do not knowingly collect Personal Information from anyone under 18 for our own purposes. If you believe a minor has provided us Personal Information, contact us at privacy@formvessel.com and we will take steps to delete it as appropriate. A Customer that collects information from minors through its forms is responsible for any parental consent the law requires.

3. Information We Collect

3.1 Information You Provide

We may collect:

  • Contact and inquiry information: name, email address, phone number, organization, website, and what you tell us when you submit a form on the Site, request a demo, email us, book or attend a call or meeting, or otherwise contact us. When you submit a form on the Site, we also record how you arrived at the Site, such as the campaign, ad, or website that referred you and the page you first visited, and store it with your contact record.
  • Account information: name, email address, password (stored hashed), two-factor authentication settings, organization and role, invitations you send or accept, and sign-in activity.
  • Billing information: subscription, plan, seats, and billing history. Payment card details are collected and stored by our payment processor, Stripe; we receive a token and the last digits of the card, not the full number.
  • Agreements: records of your acceptance of our Terms of Service and, where applicable, your organization’s BAA, including the name, title, time, and IP address of the signer.
  • User Content: questions, messages, feedback, and other information you send us.
  • Support and communications: information you provide when contacting us (including email, phone, video, messaging platforms, or in-product support).
  • Marketing preferences and consents: opt-in/opt-out choices for emails, SMS, calls, and other channels.

3.2 Information Collected Automatically

We may collect:

  • Device and usage data: device type, operating system, browser type, language, time zone, session activity, pages viewed, links clicked, features used in the Service, performance data, and diagnostics.
  • Identifiers: cookie identifiers, device identifiers, and advertising identifiers (where permitted), and related attribution data.
  • Log and audit data: IP address, user agent, referral URLs, request paths, and timestamps, and, in the Service, an audit log of actions taken in an organization (for example, who created, published, or exported a form, and when), which we keep for security and so Customers can meet their own compliance obligations.
  • Location: approximate location inferred from IP address (e.g., city/state).

3.3 Cookies, Pixels, Tags, and SDKs

The Site may use cookies, pixels, tags (including Google Tag Manager), session monitoring tools (such as screen recording and click-tracking software), and similar technologies to:

  • keep you signed in,
  • remember preferences,
  • understand usage and improve performance,
  • measure marketing effectiveness and attribution, and
  • help prevent fraud and abuse.

Some of these technologies are provided by third parties, including Google Analytics and advertising pixels such as Meta and LinkedIn (see Section 6). You can limit cookies and tracking through your browser or device settings (see Section 7); disabling them may affect how the Site works. The Service itself uses only the cookies needed to keep you signed in and secure.

3.4 Information From Other Sources

We may receive information about you from public sources (for example, websites, press, social networks, and professional networks), from data, CRM, and marketing providers, and from referrals, and we may combine it with information we collect through the Site. We use it to understand who visits the Site, to answer you, and to contact you as described in Section 4.

4. How We Use Information

We use Personal Information to:

  1. Provide and operate the Site and the Service (including creating and managing accounts and organizations, processing subscriptions and payments, hosting forms, storing submissions, sending invitations and sign-in codes, and maintaining the Site and the Service).
  2. Respond to questions and messages and create content (answering what you ask, and using questions and suggestions to decide what to write).
  3. Improve and develop the Site, the Service, and our offerings (including analytics, debugging, testing, research, feature development, and developing new content, features, and offerings, using information such as questions, feedback, support requests, and usage).
  4. Customer support (responding to questions, troubleshooting, and user requests).
  5. Security and fraud prevention (monitoring, detecting, and preventing malicious, deceptive, or illegal activity, rate limiting, and keeping audit logs).
  6. Marketing and communications:
    • send service-related messages (e.g., security alerts, account and billing notices, sign-in codes, and updates);
    • send promotional messages via email, SMS/MMS text, phone calls, voicemail (including ringless voicemail drops), messaging platforms, and other channels you provide or enable, by manual or automated means, including automatic dialing systems and prerecorded or artificial voice messages, subject to applicable law and your choices/consents.
  7. Measure marketing performance (conversion tracking, attribution, retargeting, audience measurement, and campaign reporting).
  8. Legal compliance and enforcement (comply with law, protect rights and safety, and enforce our terms and agreements).

Customer Data is used only as Section 1.1 describes.

5. AI Tools, Automated Processing, and Machine Access

5.1 Our Use of AI Tools

We may use AI tools to help operate the Site and our business, for example to draft or summarize correspondence, organize questions and messages, research topics, analyze data, and draft and edit content. Inputs to those tools may include Personal Information and User Content you provide. We do not provide Customer Data to AI tools except as a Customer directs or as the BAA allows. AI Output may be inaccurate or incomplete, and a person at Form Vessel is responsible for decisions and for what we send you.

5.2 Use of Information to Improve the Site and the Service

We may use User Content, usage data, and feedback to improve the Site, the Service, and our work and to develop new content, features, and offerings. Where feasible, we use aggregated or de-identified information for analytics and improvement. Information derived from Customer Data is used for these purposes only in aggregated or de-identified form that does not identify a Customer or a Respondent.

5.3 Third-Party AI Providers

We may use third-party AI infrastructure/providers. When we do, we may transmit necessary data (including your inputs) to those providers to generate AI Output and operate the Site. We take steps designed to limit disclosures to what is necessary and to require appropriate safeguards.

5.4 Machine Access to Public Content

The public content of the Site (the Learning Center and related pages) is made available to search engines, AI assistants, and other software under the content policy stated in our Terms of Service and in our machine-readable signals (indexing and brief excerpts or summaries, attributed and linked to the source page, are permitted; use as training data, bulk copying, republication, and derivative works are not). This concerns our published content. Personal Information we publish is described in Section 6.6.

5.5 Your Choices

If we offer settings or mechanisms to limit certain AI-related uses, we will honor those choices where reasonably available. You may also contact us at privacy@formvessel.com with requests described in Section 10.

6. How We Share Information

We may share information in the following situations:

6.1 Service Providers and Vendors

We share information with vendors who help us operate the Site, the Service, and our business, such as:

  • cloud hosting, content delivery, database, and file storage services,
  • payment processing,
  • analytics, tag management, session monitoring, and performance monitoring,
  • CRM, marketing automation, and customer support tooling,
  • marketing measurement and attribution,
  • communications providers (email, SMS, telephony, video meetings, and messaging), and
  • AI infrastructure/providers.

These vendors may access information only to perform services for us and are required to protect it consistent with their role. Vendors that may handle PHI on our behalf sign business associate agreements with us.

6.2 Within Your Organization

If you hold an account, your name, email address, role, and activity in the Service are visible to the owners and administrators of your organization and, for client organizations, to the agency that manages them. If you contact us on behalf of a company, we may share your information with that company.

6.3 Business Transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, we may transfer information as part of that transaction, subject to standard confidentiality protections and, for PHI, to HIPAA.

6.4 Legal and Safety

We may disclose information if we believe in good faith that it is necessary to:

  • comply with law, legal process, or lawful requests,
  • protect the rights, safety, and security of users, DevNoun/Form Vessel, or the public, or
  • prevent fraud or address security issues.

Law enforcement and government requests go to legal@formvessel.com and must include valid legal process.

6.5 With Your Direction or Consent

We may share information when you direct us to do so (for example, by connecting a CRM or other integration to the Service) or when you otherwise consent.

6.6 Publication

To the extent permitted by applicable law, we may publish Personal Information at our discretion in connection with the Site and our marketing, for example your name or the name you give us, and things you have said or sent us, such as a question we answer in a guide or feedback we quote, in the public spaces of the Site. We will not name your organization as a customer without its permission, and we never publish Customer Data. Published information is public and may be read, indexed, and retained in the Site’s revision history. If you do not want to be identified, tell us at privacy@formvessel.com.

7. Marketing, Tracking, and Targeted Advertising

We use marketing analytics and measurement on the Site to understand what works (for example, which channels bring visitors). Depending on configuration and applicable law, certain partners may collect data via cookies, pixels, tags, or SDKs for:

  • analytics,
  • attribution,
  • advertising measurement,
  • recording and analyzing how visitors interact with the Site, and
  • (in some cases) interest-based advertising and retargeting.

Your controls may include:

  • cookie controls in your browser,
  • a Global Privacy Control (GPC) signal from your browser, which we treat as an opt-out of any sale or sharing of Personal Information through these technologies where the law requires,
  • device-level settings for ad tracking/advertising identifiers,
  • email unsubscribe links,
  • SMS opt-out by replying STOP (or another supported method), and
  • asking us not to call you.

We do not guarantee that all tracking can be disabled in all environments; however, we strive to honor legally required opt-outs.

7.1 Sale and Sharing of Personal Information

Under some U.S. state privacy laws, allowing our advertising partners to collect information through the Site that they may use for advertising may be considered a “sale” of Personal Information or “sharing” it for cross-context behavioral advertising. We do not sell Personal Information for money. You can opt out of any such sale or sharing by using the controls above or by emailing privacy@formvessel.com. We do not knowingly sell or share the Personal Information of anyone under 18, and we never sell or share Customer Data.

8. Data Retention

We retain Personal Information for as long as reasonably necessary to:

  • provide the Site and the Service,
  • respond to and follow up on questions and messages,
  • comply with legal obligations,
  • resolve disputes, and
  • enforce agreements.

Retention periods vary based on the type of information, why we collected it, and legal requirements. Audit logs and records of agreements are kept for as long as our Customers’ compliance obligations and ours require. Customer Data is retained for as long as the Customer keeps it in the Service and for a reasonable period after an organization is deleted or a subscription ends, subject to backups, legal holds, and the BAA. We may retain and use aggregated or de-identified information for longer periods.

9. Security

We implement administrative, technical, and physical safeguards designed to protect information, including encryption in transit and at rest, access controls, two-factor authentication, rate limiting, audit logging, and backups. However, no system is completely secure. If you hold an account, you are responsible for protecting your credentials, your email account, your authentication devices, and the sign-in codes we send you, and for telling us promptly of any unauthorized use.

10. Your Privacy Rights and Choices

Your rights depend on where you live. If you are a Respondent, your rights in your submission are exercised through the Customer whose form you filled out (see Section 1.1).

10.1 Account and Contact Information

You may be able to access, update, or correct certain information through the Service. You can also contact us at privacy@formvessel.com.

10.2 Deletion Requests

You may request deletion of certain Personal Information by contacting privacy@formvessel.com. An organization’s owner may delete the organization through the Service. We may need to retain certain information for legal, security, or operational reasons.

10.3 Marketing Opt-Outs

You can opt out of marketing communications:

Account and transactional communications may still be sent.

10.4 Nevada Privacy (Sale Opt-Out)

If you are a Nevada resident, you may have the right to opt out of the “sale” of certain covered information. To submit a verified request, contact privacy@formvessel.com with the subject line “Nevada Opt-Out Request” and include sufficient information for us to verify your identity.

10.5 Other Rights

Depending on where you live, you may have additional rights under applicable law. To exercise applicable rights, contact privacy@formvessel.com.

11. International Data Transfers

We are based in the United States. If you access the Site or the Service from outside the U.S., your information may be processed and stored in the U.S. and other locations where we or our service providers operate. We take steps designed to protect information transferred internationally as required by applicable law.

12. Third-Party Links and Services

The Site and the Service may link to or integrate with third-party websites or services operated by others. We are not responsible for their privacy practices. Review their privacy policies before providing information to them.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will change the “Last updated” date at the top of this page, and if changes are material we will provide notice as required by law (for example, via the Site, the Service, or email). Your continued use of the Site or the Service after an update means you accept the updated Privacy Policy.
